Definition
- Found in Section 1-10 of the General Obligations Law of the State of NY, states:
- Any persion injured in person, property...by any intoxicated person...shall have a a right of action against the person who shall, by unlawfully assisting in procuring liquor for such intoxicated person, have caused or contributed to such intoxication: and in any such action such person shall have a right to recover actual and exemplary damages.
- Plaintiffs that sue under this act get: damages suffered as a result of injury by an intoxicated person
- "Exemplary Damages" if it is proved that there was recklessness...wanton disregard of duty by bartender
