Statutory lien

Definition
passed by state legislatures so they arise by operation of law, not by consent of debtors.  Arises when a  party adds value to another party's property by agreement.  It is the right of one person to retain possession ofthe property of another until the owner pays for the goods/services.

Definition
lien on debtor property that arises from one party's resorting to the court system to collect a debt.  they are the results of actions taken by a judge who has ruled in favor of the creditor.  It is a legally enfoceable interest in property that secures performance of an obligation, such as payment for a debt.

Artisan's lien
Definition

for a repairer or improver of personal property, such as an automobile, who retains possession of the property until paid.  The lien terminates when payment is tendered or when the repairer surrenders possession of the property. 

(If they give you your car back without you paying they lose their legal interest)

Definition
liens against real property that secure unpaid debts that arise from contracts for labor, materials or services to improve specific real property.  Must file within 60-120 days after work is substantially complete.

lien is enforceable only as to items to which liens may legally attach.  Statues may allow the lienholder to foreclosethe lien judicially and sell the property if the owner does not pay the debt.

Types of Judicial liens

Definition

Monetary judgement (issued to a party to pay) - writ of execution (sherriff will seize and sell specific nonexempt property of the judgement debtor to satisfy the judgement) - attachment (seizing a defendant's nonexempt propperty under judicial authorization and placing it in the custody of the court)

  • Replevin - prejudgement remedy intended to secure property already subject to a lien of or right of reposession by the plaintiff (reposesson of an automobile)
  • Garnishment - prejudgement or postjudgement collection remedy directed against a third party who holds property of the defendent (wages or bank accounts)

right to retain an existing lien until the debt is paid is a substantive property right that may not be taken from a rightful lienholder.  a lien is effective until it is satisfied or otherwise terminated.

fraudulent transfers

transfer of property made with the purpose and intent to delay, hinder, or defraud creditors.  this is voidable by the transferor's creditors.  badges of fraud include:

  1. debtor's retention of possession or beneficial interest
  2. transfer of substantially all assets
  3. transfer in sectret
  4. transfer to a family member or insider
  5. transfer for inadequote consideration
  6. transfer in anticipation of legal action or financial problems
  7. removal or concealment of assets
  8. insolvency at the time of or shortly after the transfer.

these are found in the uniform fraudulent transfer act.

Definition
title 1 of the consumer credit protection act requires disclosure by creditors of the terms and conditions of consumer credit before extending credit to consumer debtors

Definition
extended for a specific time period (start/stop date).  total amount financed, number of payments and due dates are all agreed on at the time of the transaction

plan that permits the consumer to enter into a series of transactions.  plan allows the consumer the option of paying in variable installments or in full.  it is not always possible to disclose the total amount financed, total payments, etc.

finance charge and annual percentage rate (APR) must be disclosed to borrowers in this before credit is extended.  state usury laws restrict the rates charged but this is almost nonsense because they either don't exist or the rate is extremely high

limited to $50 for unauthorized use of the card.  also says credit cards cannot be distributed to a person who has not applied and if someone has a problem with property or services purchased with a credit card they have the right not to pay the amount due.  however, the purchaser must first attempt in good faith to return the goods or give the merchant a chance to correct the problem.

requires consumer credit reporting agencies to adopt reasonable procedures to maintain the confidentiality, accuracy and relevancy of their records while meeting the needs of lenders.  this has statutory attorney fees if you win.

Definition
on character, repuration, etc is not to be prepared on a consumer until they are notified and given the right to request information about the investigation.  consent to request the report is commonly required when an individual makes an aplication for which the report is needed (employement or insurance).  this is far more extensive than a credit report.  it is kept in a credit file with employement history, judgments, arrest recoreds and individuals have no rights to make adjustments.

equal credit opportunity act (ecoa)

prohibits discrimination based on sex, marital status, color, age, religion, national origin, or receipt of welfare in any aspect of a consumer credit transaction .  if you are applying for a "joint"  thing then they must know the income, etc, of your spouse, but otherwise that is not considered.

fair debt collection practices act (fdcpa)
Definition

contains a number of restrictions on collection practices.  was enacted to prevent abusive, deceptive and unfair debt collection practices on some debt collection agencies.  this regulates the debt collection industry and applies to entities that collect consumer debts for others but not to bans and busineses that collect for their own accounts.  must invovle money, propety, insurance or services obtained by a consumer and used for personal family or household purposes. collector may not contact the consumer/debtor about the account after receiving a written refsual not to pay except to notify the consumer of ramifications of nonpayment.  collector generally may not:

  1. use harassing practices
  2. use abusive laungage
  3. use false or misleading tactics
  4. contact the consumer at work
  5. contact the consumer at unusual or inconvenient times
  6. contact consumer at all if debtor is represtned by an attorney
  7. contact third parties other htan a spouse, parent or financial advisor about the account unless authorized by court

enforces the fdcpa.  permits civil actions, including class action suits, by the affected debtor, and a debt collector can be liabile for up to 1,000 statutory damanages without proof of damages for violation of the act

fair credit billing act
Definition
gives the consumer a method of correcting errors on bills and bringing disputed charges to teh attention of the creditor.  the creditor is required to inform customer of rights with each billing statement.  customer has 60 days to make an inquiry after receiving a bill.

bankruptcy abuse prevention and consumer protection act of 2005
Definition
made it difficult to declare bankruptcy.  the proceedings are always administered in federal bankruptcy courts and represent a formal alternative means to resolving the conflict between creditor rights and debtor relief.  objective is to ensure that debtor assets are equitably distributed to creditors and the debtor is given a fresh start.

  • chapter 7 is liquidation.  usually voluntary filed by debtor.  can be involuntary filed by creditors.  businesses and individuals.
  • chapter 11 is reorganization.  is businesses and rarely an individual.  voulntary or involuntary.  if a business does an assignment for the benefit of creditors the creditor will often file this.
  • chapter 13 is personal reorganiation.  only voluntary by individuals.  allows you to try to keep as many assets as possibly and buy time.   creditors collect money here.

filing of a bankruptcy petition specifying the chapter under which relief is requested, this usually operates as an automatic stay of most civil actions against a debtor (excpt alimony, etc), then you go to bankruptcy court where the case is heard by a judge.  each federal judicial district has its own bankruptcy court. 

  • core proceedings are conducted and decided by the bankruptcy court. 
  • noncore proceedings are resolved in state or other federal courts but may affect rights of the creditors or debtor
