Unless specifgic claims/counts are requested for jury trial, it is assumed the request is made for all couts/claims; any part to a lawsuit can request a jurty trial request for all claims if it is not done so by other parties and must serve it within 14 days after being served by the other party who requested a partial jury trial

 

If no party requests a jury trial, it is deemed waived.

Amendment was ratified

3) Amount of controversy must be at least $20

 

4)Suit must be legal in nature (not equitable remedy such as specific

performance, injunction relief or restitution, thus non-monetary damages are

 

not covered as a ‘right’ under 7th Amendment)

  • In Cases where the Def. files a CC, the court can order the dismissal of the complaint but only if the CC can be adjudicated on its own/independently

 

2) Involuntarily- Def. can request a dismissial if Pl. does not comply with the rules or a court order.

The potential jurors complete questionnaires to help determine wheather they are qualified to serve on a jury. Thereafter, the court randomly selsect indiviudals to be summonded to appear for juryt duty. These selection methods help ensure that jurors are chose without regard to race, gender, national origina, age or political officiliation

Jurorrs summoned to to appear will face a process called voir dire. The purpose of voir dire is to exlcude from the  jury people who may not e able to decide the case fairly based on prejudice, knowing of the case beforehand, having a financial interest, ect.
